On Sunday, the Federal Service Council released a statement clarifying the process for appointing individuals who have resigned or been referred to retirement prior to reaching the legal retirement age. The decision specifically addresses those within the higher educational qualifications and first-category classifications.
According to the council’s statement, which was disclosed to the public, “the Federal Public Service Council issued its decision No. 385 on October 24, 2023. The essence of this decision is that there are no legal barriers preventing the reappointment of individuals who have resigned or who have been referred to retirement without meeting the legal age requirement, as long as their resignation or retirement occurred before the new employment decision made by the Federal Public Service Council.” The council further noted that no legal constraints exist regarding their eligibility for reemployment.
Additionally, the statement elaborated, “This decision pertains specifically to those eligible for reemployment from categories outlined in the Federal Budget Law No. 13 for the year 2023, specifically numbers 59 and 67 from 2017, which pertain to first-category professionals and individuals with higher qualifications, as well as Law No. 6 for the year 2000, which governs medical and health professions.”
In light of the information provided, the council urges all parties to thoroughly verify and ensure the accuracy of their understanding regarding the recently published guidelines and interpretations.
