Baghdad’s New Housing Sale Rules for Transgressors Revealed

The Ministry of Construction, Housing, and Municipalities has announced new regulations regarding the sale of housing units to individuals with unauthorized constructions.

The ministry has issued guidelines in accordance with Cabinet Resolution No. 20 of 2025, facilitating the sale of housing units to those who have built residential structures within designated urban areas intended for housing, prior to December 10, 2024. These actions align with the basic and sectoral urban designs and require the approval of urban planning authorities.

According to the instructions, applicants must demonstrate that their residential unit has been occupied and submit a request within 180 days. Eligibility stipulates that they have not benefited from a previous housing unit, and they must provide a pledge affirming they do not own any prior housing. Furthermore, they are permitted to purchase only one property; in cases where multiple properties have been constructed, the applicant will need to select one property.

The directives also outline the formation of committees to process requests, which will be chaired by the assistant director of the appropriate municipality and include officials from the Property Division and the City Regulation Division. These committees will be responsible for reviewing applications against inventory lists.
