Supreme Court Ruling Declares Job Appointment Priority Unconstitutional in Iraq

Federal Supreme Court Rules on Job Appointment Preference

The Federal Public Service Council announced a significant development on Tuesday, following a ruling from the Federal Supreme Court regarding job appointments in Iraq. The court has deemed the 2001 resolution by the dissolved Revolutionary Command Council (RCC) as unconstitutional, which provided preferential treatment in job appointments.

In an official statement, the Council indicated that the court found Resolution No. 190 from the RCC unconstitutional based on articles 14 and 16 of the 2005 Constitution of the Republic of Iraq.

The Legal Department of the Federal Public Service Council had initiated this legal challenge by filing a case (numbered 263/federal/2024) to contest the constitutionality of the aforementioned resolution.

This ruling underscores the principles of equality and equal opportunity enshrined in the Iraqi Constitution, effectively abolishing any unconstitutional privileges that have previously influenced job appointments.
