Iraq’s Justice Ministry Forms Committee for Real Estate Return Law

On Saturday, the Ministry of Justice announced the establishment of a committee aimed at overseeing the execution of Law No. 3 of 2025, which pertains to the restitution of real estate to its rightful owners. This initiative is expected to undergo implementation over a span of six months.

The committee is focused on the enforcement of Law No. 3 of 2025, which nullifies the provisions from the Law of the dissolved Revolutionary Command Council and facilitates the return of properties to their original proprietors. The committee, led by Ziyad Al-Tamimi, the senior deputy of the Ministry of Justice, comprises representatives from the Financial Supervision Bureau, the General Secretariat of the Council of Ministers, and the Ministry of Agriculture.

Addressing the Cabinet Resolution No. 29 of 2012, a spokesperson from the Ministry of Justice indicated that steps to implement this resolution remain unfinished. A recommendation was forwarded to the Prime Minister to form a new committee, to be chaired by the Director General of the Agricultural Land Department within the Ministry of Agriculture, to assess the status of individual cases and enable citizens to resume agricultural activities, free from legal hindrances.

Furthermore, the committee has advised the Prime Minister to direct the Kirkuk Operations Command to eliminate encroachments on properties that are not under legal dispute, thereby allowing owners to engage in lawful activities concerning their estates.

Additionally, the committee proposed that the Kirkuk provincial office, along with local administrative leaders, establish teams to visit affected areas and inform farmers that the issuance of directives for implementing Law No. 3 of 2025 would adequately address the challenges they have faced for many years.
